Worcester Divorce Modification Attorneys

Need to Change Your Divorce Agreement? Do You Have Questions About How to Increase or Decrease Your Support Payments?

When it comes to family law matters such as child custody, child support, and alimony, the legal issues never really end. They just change.

The Worcester Modification Attorneys from The Massachusetts Family Law Group commit close to one-third of their time working with prior clients who have had changes since the last time they were in court, and with new clients fixing some of the overlooked or silent issues not addressed in the Agreement from their last attorney.

For a no-obligation consultation with one of our attorneys, contact us at (800) 970-LAWYER or use our online form to inquire about our aggressive and experienced representation.

Modifications Require a Change in Circumstances

Circumstances that could lead to a modification include moving away from the area, job loss, promotion and salary increase, remarriage, drug abuse or other criminal activity, discovery of additional marital property, or changes in the child's best interests.

As long as you can demonstrate a significant change in circumstances from the last time you were in court, a court will usually grant a modification to your current order. Our Modification Attorneys fully analyze the facts of each case and aggressively advocate with compelling arguments. Alternately, your ex-spouse may be seeking a change with which you don't agree. Either way, our legal team helps both men and women in post-divorce actions in Worcester County, and each of the different Massachusetts Probate and Family Courts.

Worcester County Handles Modifications Differently Than Some of the Other Courts

When you search for names of attorneys who can help you with changing your Separation Agreement, find one who has experience in Worcester County. Since every court and each judge has his or her own philosophy on what constitutes a "change in circumstances," having a lawyer who spends a significant amount of time in Worcester, and who has a working understanding of your particular judge, can make a big difference.

For example, some judges simply refuse to enter temporary orders on a Complaint for Modification; others will consider it so long as the request is reasonable.

If You and Your Former Spouse Agree to Modify the Agreement on Your Own, All Changes Must Be in Writing

You and your former spouse can - and should - work together in adapting to changes in the parenting schedule or finances on some occasions, but if the two of you have a highly volatile relationship, realize that changes you agree to outside of court are not going to be enforceable in court. So if you agree, for example, that your ex will return the children on Saturday at 7pm and not on Sunday like your court order says, you have no recourse, other than going to court and asking the court to modify the order.

Experienced & Aggressive Modification Attorneys in the Worcester Probate and Family Court

Our attorneys know the kind of evidence and types of oral arguments and motions to present - all with an eye toward getting things seen your way.

Does that mean that we litigate every modification case? No. However, we do prepare each case as if it is going to trial. Our preparation and willingness to go all the way tends to lead to more favorable settlement offers.
